A brief history of this case and the corruption of the state that lead to Mr. Kelly's illegal imprisonment. Let's start with Annie Reeves, the one who made the first complaint to the police. She was raped at the age of 8 to 15 years old. She had told the alleged victim of her own past of being raped. She took the alleged victim into a room where the child was never allowed to go. When she first asked the child if anyone had ever touched her (as she did regularly with the kids that lived there.) The child stated "Not that again". This sounds like Annie Reaves hounded her kids in wanting to get the answer she wanted to hear. After 4 times in asking in 20 minutes, the alleged victim said "yes, it was papa". When asked why she said "yes', the child stated because "she (Annie Reaves) was being nice to her." This has a flavor that Annie Reaves wasn't nice to the child. If the truth was revealed that Annie Reaves didn't like the child,. This can be seen in an email that Annie Reaves wrote to the Grandparents begging them to take them for week-end visits because they were too much for her. Annie Reaves made a statement.to the police OR the main interview that Mr. Kelly had many guns, insinuating it would not be easy to arrest him. Mr. Kelly had actually removed all his guns from the house because he noticed that is grandchild liked to snoop. When the police searched the Kelly house, no guns we found. The police officer that came to Annie Reaves' to do the interview said under oath, that he had asked many leading questions. The Defense after studying the interview, took note that Annie Reaves spoke about 1100 words during the interview. The supposedly trained officer spoke 400 words. Annie Reaves asked many leading questions. The interviewing officer said that he only had 1 hour training if interviewing sex victims in Rookie School. Oregon State is one of few that have created guide lines for interviewing sex crimes. The D.A. mad light of all this and twisted his own take into all this to the jurors, disregarding what was on record ofthe interview. Also, during the first interview, you'll hear Annie Reaves asking the interviewing policeman if he would shut off the recorder. Annie Reaves not wanting to have on tape of what she was about to say. Only when the D.A.'s report came out do we learn what was said. Annie Reaves tells the interviewer that she believed that~r. Kelly molested his own daughter when she was young. Annie Reaves said in the report that she felt Aime Kelly (Mr. Kelly's Daughter) had problems. That report also said, that Mr. Kelly's son was asked about that (Annie Reaves boyfriend). He said the thought there was an investigation of that, but.no follow up. When the D.A.'s report came out, the Kelly's family was enraged at the accusation. Aime Kelly called her brother, Thomas A. Kelly and asked him why he "said what was in that report. He said that he DIDN'T. He also said that he was going down to the Sherriff's dept and ask them HOW, WHO, and WHY this was in the report. According to Thomas A. Kelly, the interviewing officer said it was "HIS TAKE on it. That accusation also was taken to the Grand Jury to support their case against Thomas Michael Kelly, in which an indictment was issued. Aime Kelly wrote a letter denying that accusation and Lily Kelly (Mr. Kelly's wife) stated it NEVER happened and that there was NO investigation. The truth of it is this ... Thomas A. Kelly (Mr. Kelly's son) was under investigation in 1998 for molesting HIS girlfriend's 8 year old daughter. The report says that a 14 year old girl (the older daughter of Thomas A. Kelly's girlfriend) saw Thomas A Kelly shut the living room curtains, set the child on his lap and put his hands between her legs. The 14 year old was a good student and mentally sound. The case was dropped, In THIS case (THOMAS MICHAEL KELL Y) it is a case involving the alleged victim, a 6 year old with many mental issues who tells WHOPPING LIES with NO PHYSICAL EVIDENCE. This is a child that turned her father in for beating her with a stick. She accused a teacher of slapping her across the face. The one that said that her grandfather's sperm was in her words "Yellow Squiggly Stuff'. This child had CRIED WOLF many, many times. Mr. Kelly's history is sound. The 14 year old girl that saw Thomas A. Kelly put his hands between the 8 year olds legs was sound. It's the same legal system in Astoria, Oregon in both cases. In our opinion this is CORRUPT. The arresting officer from the Astoria Police Dept, the one who hand-cuffed Mr. Kelly in 2006, was himself in 2008 arrested for having sexual relationships with minors from 2005-2008. He didn't see prison or jail time. He was released from jail just a few hours later. He was charged with misconduct on his job. But he should have been charged with a measure 11 crime which would have sentenced him to 8-20 years in prison. This is the second Astoria police officer to have committed such a crime a few years apart and was only dismissed from the police force. In the search ofMr. Kelly's house, a chair was taken that Mr. Kelly sat in for at least 3 hours a day for years. More will be said on this as the story progresses. In our opinion the Jury Pool was stacked. The Defense, after rejecting 6 jurors, by law, the DA also.rejected 6, ended up with 3-4 people who had family members who had been sexually molested but didn't go to the authorities about it. 3 of them know the D.A.; one ofthem went to the same church as the DA did. Two preschool teachers and several county employed workers, and one contractor. In my opinion the jury was stacked in the states favor. The one contractor found Mr. Kelly innocent of all charges. Interesting, isn't it? The State had an Oregon State Forensic Lab do DNA tests on the chair mentioned earlier in this brief report. Two state police Lab Tech's testified by telephonic phone testimony thata small amount ofMr. Kelly's DNA was found on the chair cushions in his house. No DNA of the alleged victim was found. The states own witnesses testified that the DNAcould be 25 years old, and didn't know how it got there. There's 150,000,000 sperm in an ejaculation and only 1-50 were found that were under layers of dirt and grime. Many tests had to be done to find them. From black lights that didn't show anything to blood tests with black lights that didn't show any. When all was said on this, the DA in his closing statements said to the jury. The Oregon State Police Forensic Lab Techs had it right. It is my opinion that the jury couldn't hear the telephonic phone testimony from where they were. The speakers were in front of the judge's bench. The jury was at least 85 ft away from the speakers, which were small. The jury took the DA's word as if that's what the Oregon State Forensic Lab Techs had said, when the truth leaned more towards the Defense in their discovery of the DNA samples which could be found in everyone's home that lives on the planet. Sperm heads are even smaller than the head of a needle. Less than 10% of 1 % was found, out of 150,000,000 and even less than that in Mr. Kelly's own home. The D.A., said, in a newspaper article that it was the DNA ofMr. Kelly that sealed the States case. The D.A. also said to the Jury that many people.have gotten away with this crime and Mr. Kelly MUST PAY. The D.A. knew there were family members of people who were sexually assaulted on the jury. What he was telling them is that Mr. Kelly should pay for all those who get away with this crime. He made Mr. Kelly a Martyr (We are using the word Martyr because the D.A. also told the public that Mr. Kelly didn't look like a man who's life is over, after Mr. Kelly smiled in the face of his accusers and those who judged him) and the object of the jurors revenge to those who didn't pay for such a heinous cnme. Knowingly, the D.A. made Mr. Kelly a sacrificial lamb, he gave the jury an offering to get a conviction with NO EVIDENCE, telling them that Mr. Kelly was the most evil person in the world. The alleged victim, who was coxed to make a statement by Annie Reaves, had accused her own father of beating her with a stick a year before Mr. Kelly was arrested. She accused a teacher of slapping her across the face while in school. He parents were asked not to bring her back to two different daycare centers, where many problems arose, even having to call the police to help them out with her. A Psychologist, who saw her before, said that she tells Whopping Stories. The alleged victim was diagnosed with many mental issues such as Asbergers, which colored pencils would tell her what to do. Each color being good or bad, friend or foe. She has Autism. Attention deficit disorder, hyperactivity, obsessive-compulsive disorder, and oppositional defiant disorder. Lily Kelly (Mr. Kelly's Wife) was looking at a medical guide book when the grandkids came up to her. The grandson (a year older than alleged victim) asked her where babies come from. Lily showed the grandkids a diagram picture in the medical guide book of a full term pregnant woman which showed the inward parts: When the kids asked how the baby got in there, Mr. Kelly said the woman has the egg and the man gave the good stuff. The D.A. in this case made a BIG DEAL out of the term "Good Stuff' to the jury. Dr. McGovern who testified for the defense, testified many people use many different to express such things, and there isn't a book on the planet that anyone using the term "Good Stuff' to mean sperm is a sex offender. Mrs. Kelly testified that the term "Good Stuff' was used instead of the word Sperm, in a light way. Many advertisements on TV and Radio advertise their product is best because the y have "The Good Stuff'. This is where the term actually came from, hearing it on TV. The alleged victim was caught watching a porn tape that she found in the basement of the Kelly home which was in the shop TV area. Mrs. Kelly testified that the 2 tapes that were her sons (Thomas A. Kelly). These tapes were found in her son's stored belongings. The court asked that her testimony of that be struck from the record. But is found on the trail CD's and transcripts. The alleged victim said that her Papa had tons of Porn. The D.A. in an article said that lots of porn was found in the Kelly house. In the search of the Kelly house, only these 2 tapes were found in the basement area drawers. When the alleged victim was asked, " ... and your Grandma and Papa got upset with you for getting into things that you shouldn't downstairs didn't they"? And she answered "Yes". But, before that time, she said her Papa forced her to watch them. Then in an interview with a social worker she said, "Can I tell you my favorite part"? All these statements are on documents the defense has. In the opinion if the defense, both Annie Reaves and Thomas A. Kelly perjured themselves while under oath. Both were asked if they had porn in their home. Both replied strongly "NO". The defense had proof that Annie Reaves had over 60 porn sights on her profile page and Thomas A. Kelly had over 200 porn sights. Porn that a normal mind couldn't even dream of if he tried. The court denied the defense to present the evidence in trail. Annie Reaves on her Web Profile Page said she was a Psychologist, in bold lettering. She had no degree's if education to match this declaration. The alleged victim was proven to know about computers, and admitted watching movies and playing games on computers. She knew about the virus' computers get. The defense was trying to prove that the child seen, and know about porn. But the court denied and tried to block the jury from seeing that. The state brought in an expert witness. A doctor who made a physical exam of the alleged victim. The victim was found to have no physical injuries. But, he made a statement of opinion to the jury that he felt that she had been sexually abused. His statement of opinion had no scientific grounds of sex abuse. But he made it. The Defense asked for acquittal after his testimony. The judge, of only a few months, on the 3rd bench of Clatsop County, that also worked as a prosecutor said, "Acquittal denied, for we have the expert opinion, of a Doctor of Sex Abuse". The Dr. Had no history of the child's mental disorders, even though he had access to those records. In our opinion, the Dr. perjured himself and the Judge and D.A. knew it. We're not just saying this, but have evidence that he did. We must hold this back at this time as with other information that is documented. Also this Dr's opinion of physical se-xual abuse was brought before the Grand Jury to indict Mr. Kelly. The Oregon Supreme Court ruled that an Opinion of sex abuse before a jury was a violation and has NO SCIENTIFIC GROUND to make such an opinion by an expert witness without PHYSICAL EVIDENCE. The defense brought forward two expert witnesses. Dr. Author & Dr. McGovern, who together, had 75 years of experience and education in dealing with sex abuse and abused people. The state, in their rebuttal against the defenses blue brief (brought before the appellate court) said the defense had no expert witnesses, of course, THE STATE LIED, and at this point, was lying to the appellate court judges to taint their view of this case, which didn't work. The appellate court judges were non bias and very knowledgeable to Mr. Kelly's case. The defense in the appellate argument poured out the law and supporting cases. The state didn't have anything to support their claim against Mr. Kelly. The leading Judge asked the state prosecutor why this case was taken to trial. The state said, "We had to pursue it". Well, they pursued it illegally. With Mr. Kelly's lawyer saying, that Mr. Kelly is in prison illegally. This was a Red flag proclaiming a lawsuit is in the making. We don't believe the tax payers of Oregon will be too happy to pay, once they hear of this injustice of sending an innocent man to prison which will costs them millions of dollars in restitution. The thing that stands out in this case, is Judge Matayas, Clatsop County's 3rd seat judge, telling Mr. Kelly on the day he was sentence that he got a fair trial. .. This, in our opinion· gives new meaning to HONORABLE JUDGE.
