It is an editor's brief statement of the essential features of the measure as introduced. Creates crime of making false accusation of sexual abuse or kidnapping. Punishes by maximum of five years' imprisonment, $125,000 fine, or both. A BILL FOR AN ACT Relating to false accusations. Be It Enacted by the People of the State of Oregon: SECTION 1. { + (1) A person commits the crime of making a false accusation of sexual abuse or kidnapping if: (a) The person intentionally: (A) Alleges that another person has: (i) Committed a sexual offense against the person; (ii) Subjected the person to sexual harassment; or (iii) Kidnapped the person; and (B) Makes the allegation to a law enforcement agency; and (b) A court determines that the allegation is false. (2) Making a false accusation of sexual abuse or kidnapping is a Class C felony. (3) In addition to any other sentence a court may impose, the court shall include in the sentence of a person convicted under this section an order that the person: (a) Pay all costs incurred by the victim in defending the allegation; (b) Undergo a psychological evaluation to determine appropriate treatment; and (c) Make a private and public apology to the victim. The defendant shall make the public apology by causing a letter of apology to the victim to be published in print media. If the original allegations were published in print media, the letter of apology shall be published in the print media that covered the original allegations, on an equivalent page to the original coverage. + } ----------
